US Judge Mandates Freedom of Kilmar Abrego Garcia from ICE Custody
A court has ruled the immediate release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement is without legal authority.
"Since his return from wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her order.
The case originates in a mistaken removal to El Salvador in March, which US authorities later admitted was an error. After his repatriation to the United States to answer alien smuggling charges, he was detained in immigration custody.
In her decision, the judge noted that the authorities lacks a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "for now."
